PERSONAL TRAINING TERMS AND CONDITIONS
(1:1 AND 2:1 SESSIONS)
Storm-Fitness Ltd (“Storm”) a company registered in England and Wales. We are registered at Companies House under company registration number 07228134 and our VAT registration number is 141189229.

1. PARTIES, STATUS AND BASIS OF THIS PERSONAL TRAINING AGREEMENT
1.1 In these terms, “Trainer”, “we”, “us” and “our” refer to the individual personal trainer who delivers a particular Session to you. Different Sessions may be delivered by different Trainers but only if agreed by the client.
1.2 “Storm Fitness” (“Storm”) refers to the gym business which provides facilities and administrative systems and may act as a booking and/or payment collection agent for Trainers.
1.3 For each Session you attend, your contract for personal training services for that Session (the “Services”) is between you and the Trainer who delivers that Session. Storm is not the supplier of the Services and is not a contracting party, except to the limited extent that it provides facilities and administrative support.
1.4 Where Storm collects or processes payments, it does so solely as an agent on behalf of the relevant Trainer(s). All such payments are treated as payments to that Trainer (or those Trainers).
1.5 Each Trainer is responsible for:
The design, scheduling and delivery of the Sessions they provide to you;
Setting the prices for those Services (as notified via Storm or directly); and
Any tax obligations arising from the supply of those Services to you.
2. SERVICES AND SESSION TYPES
2.1 The Services consist of structured exercise, fitness and/or wellness coaching sessions delivered by a Trainer, usually at Storm’s facilities (unless otherwise agreed in writing).
2.2 Sessions are offered in the following formats:
2.3 You may train with more than one Trainer over time. Your programme may be designed and/or updated by one or more Trainers, but for each Session, the Trainer delivering that Session is the person supplying the Services to you for that Session.
2.4 The Trainer will:
Discuss your aims, objectives and relevant health information;
Design a training and wellness programme specifically for you (and, for 2:1, jointly with the other client); and
Review and adapt that programme as you progress.
2.5 Each Session lasts up to 1 hour (a “Session”) unless you and your Trainer expressly agree otherwise.
2.6 The Services are personal to you and may not be transferred to or shared with anyone else, other than as part of an agreed 2:1 arrangement.
3. SUBSCRIPTIONS AND SESSION CREDITS
3.1 Subscription options
3.1.1 Subscriptions are based on how many Sessions per week you wish to train with a Trainer (typically 1, 2 or 3 Sessions per week, for either 1:1 or 2:1 training).
3.1.2 Current subscription prices and whether they apply to 1:1 or 2:1 Sessions will be confirmed via Storm or by a Trainer.
3.1.3 Subscription payments are taken every 4 weeks in advance and cover the following 4 weeks of Sessions.
3.1.4 You will normally receive an email notification from the payment provider a few days before each payment is collected.
3.1.5 Subscriptions can be cancelled, paused or changed at any time via the “MANAGE PT PAYMENT” page on Storm’s website. You must also inform your Trainer of any changes that affect booked Sessions.
3.2 Session Credits under subscriptions
3.2.1 Depending on your chosen subscription, you will receive 4, 8 or 12 Session Credits every 4 weeks.
3.2.2 Session Credits can be used only for the format agreed:
1:1 subscriptions → 1:1 Session Credits;
2:1 subscriptions → 2:1 Session Credits (for you and the agreed training partner).
3.3 Unused Session Credits
3.3.1 If you do not use all your Session Credits within the 4‑week billing period, they will remain on your account.
3.3.2 You may:
Use them as additional Sessions in later weeks (subject to Trainer availability); or
Pause your subscription to use up accrued Credits.
3.3.3 Session Credits expire 12 months from the date of issue. You can check your balance via the Mindbody website or by asking a Trainer.
3.4 Extra Session Credits
3.4.1 If you use all of your Session Credits before the end of a 4‑week period, you may purchase additional one‑off Sessions. A Trainer will provide a payment link for these.
3.4.2 You may request to increase the number of weekly Sessions on your subscription. A Trainer will confirm if this is possible and the applicable price.
4. BLOCK BOOKINGS AND INDIVIDUAL SESSIONS
4.1 Block bookings
4.1.1 If you do not wish to use a recurring subscription, you may purchase Block Bookings of a fixed number of Sessions (for example, 4, 8, 16 or 24 Sessions), for 1:1 or 2:1 as agreed.
4.1.2 Block Bookings must be paid in full in advance before any Sessions are delivered.
4.1.3 Block Bookings are non‑refundable, except where you are certified by a doctor as medically unfit to participate, in which case a refund for unused Sessions may be provided at the relevant Trainer’s discretion.
4.1.4 Block‑booked Sessions are valid for 12 months from purchase, unless otherwise agreed in writing with a Trainer.
4.2 Individual Sessions
4.2.1 You may purchase individual Sessions on a one‑off basis, in advance.
4.2.2 Where you purchase two or more individual Sessions in advance, they will be valid for 12 months from purchase.
4.2.3 Individual Sessions are only available if you have already completed an initial subscription or block to allow for proper assessment and planning.
5. PAYMENTS AND ACCOUNT STATUS
5.1 All payments for Subscriptions, Block Bookings and individual Sessions are made online. A Trainer will provide payment links or instructions on how to purchase sessions.
5.2 Where a payment covers Sessions delivered (or to be delivered) by more than one Trainer, Storm collects that payment as agent for each relevant Trainer in respect of their share of the Services.
5.3 No training Services will be delivered unless your account is in credit. Trainers may suspend or cancel Sessions where payment is overdue.
5.4 You are responsible for ensuring that your payment details are correct and that sufficient funds are available on the relevant payment date.
6. BOOKING, CANCELLATION AND LATENESS
6.1 Booking Sessions
6.1.1 Once you have purchased a package with your Trainer, you will arrange Session days and times directly with them (by text, email or other agreed method).
6.1.2 You are encouraged to book Sessions in advance to secure your preferred times, your Trainer will advise.
6.1.3 You must not over‑book or reserve more Sessions than you reasonably intend to attend. If over‑booking is identified, your Trainer may cancel some reserved Sessions.
6.2 Arriving for Sessions
6.2.1 It is recommended that you arrive at least 10 minutes before your Session start time so that you can begin promptly and make full use of the Session.
6.3 Rescheduling Sessions
6.3.1 Requests to reschedule a Session will normally be treated in line with the Cancellation Policy at clause 6.4. This means that if you ask to move a Session with less than 24 hours’ notice, the Session Credit will usually be treated as used.
6.3.2 In exceptional circumstances only (for example a genuine medical emergency, serious family emergency or significant travel disruption outside your control), a Trainer may, at their sole discretion, allow a late reschedule without loss of the Session Credit. Evidence of the emergency may be requested.
6.3.3 Rescheduling for non‑urgent reasons (including change of personal plans, avoidable diary clashes or preference for a different time) will not be treated as an exceptional circumstance and will follow the standard 24‑hour rule.
6.3.4 In the first instance, you should contact the Trainer you are booked with directly. If you cannot reach them, you may email Storm at info@storm-fitness.com, who will assist in passing on your request.
6.3.5 While we will consider all requests reasonably, we cannot guarantee that a rescheduled time will be available or that an exception will be made.
6.4 Cancellation Policy
6.4.1 Early cancellations
You may cancel a Session without charge up to 24 hours before the scheduled start time (the “Notice Period”). In that case, your Session Credit will not be used.
6.4.2 Late cancellations
If you cancel a Session with less than 24 hours’ notice, the Session Credit will be deemed used and will not be refunded.
6.4.3 No‑shows
If you do not attend a booked Session and fail to give notice to Storm or the Trainer, the full Session amount will be charged / the Session Credit will be deemed used.
6.5 Late attendance
6.5.1 If you are more than 20 minutes late for a Session and have not contacted the Trainer, the Session will still finish at the scheduled end time and the full Session Credit will be used.
6.5.2 If you are less than 20 minutes late, and if the Trainer’s schedule allows, they may extend the Session so you receive the full planned duration. If this is not possible, the Session will still finish at the original time and the full Session Credit will be used.
6.5.3 Full duration cannot be guaranteed if you arrive late.
6.6 Trainer unavailability and lateness
6.6.1 Where reasonably possible, Storm and/or the relevant Trainer will provide at least 7 days’ notice if that Trainer will be unavailable for scheduled Sessions (for example, holidays). You may be offered an alternative Trainer.
6.6.2 If a Trainer is unable to deliver a Session at short notice due to illness, emergency or other unforeseen circumstances, Storm will try to provide a replacement Trainer. If no suitable replacement is available, you will not be charged for that Session and your Session Credit will not be used.
6.6.3 If a Trainer is going to be more than 5 minutes late, they will seek to contact you. If they are 10 minutes or more late, that time will be added to that Session (where possible) or credited to a future Session.
7. HEALTH, SAFETY AND SUITABILITY TO TRAIN
7.1 Your health and safety are the main priority of each Trainer and of Storm.
7.2 You agree to:
Complete any health questionnaires or screening forms honestly and in full;
Inform a Trainer of any existing or new medical conditions, injuries, pregnancy or other factors that may affect your ability to train; and follow any medical advice given by your doctor or healthcare professional.
7.3 You are responsible for consulting your doctor before starting or significantly changing any exercise programme, particularly if you: Have or suspect you have a medical condition or injury; Are pregnant or post‑natal; or Have been advised to limit physical activity.
7.4 Any Trainer may, at any time, decide that it is unsafe for you to continue a Session (for example, due to illness, injury, inebriation or other concern). In such cases, the Trainer may refuse to start or may stop the Session.
7.5 You should only attend Sessions if you feel fit and well enough to train. If in doubt, you should seek medical advice and inform a Trainer accordingly.
8. RISK, LIABILITY AND DISCLAIMER
8.1 Inherent risks of exercise
8.1.1 You acknowledge that physical exercise and training carry inherent risks, including (but not limited to) muscle soreness, strains, sprains, falls, and in rare cases more serious injury.
8.1.2 By participating in the Services, you accept these risks and choose to take part voluntarily.
8.2 Information you provide
8.2.1 Trainers will rely on the information you provide in health questionnaires and discussions. You are responsible for ensuring that all information is complete, accurate and up to date.
8.2.2 Neither any Trainer nor Storm will be liable for any injury, loss or damage arising from your failure to disclose relevant information or from providing misleading or incomplete information.
8.3 2:1 Sessions – shared responsibility
8.3.1 In 2:1 Sessions, you understand that the Trainer’s attention is divided between two clients and that you must each take particular care to:
Follow instructions; Use equipment correctly; and Train within your own physical limits.
8.3.2 Each client in a 2:1 Session remains individually responsible for their own health, safety and compliance with guidance.
8.4 Limitation of liability (as far as the law allows)
8.4.1 Nothing in these terms excludes or limits liability for: Death or personal injury caused by negligence; Fraud or fraudulent misrepresentation; or Any liability which cannot legally be excluded or limited.
8.4.2 Subject to clause 8.4.1, Trainers and Storm will not be liable for:
Any loss or damage that is not a foreseeable result of their breach of contract or negligence;
Any loss of profit, business, or expected savings; or
Any loss or damage arising from your failure to follow instructions, use equipment properly or comply with these terms.
8.4.3 Subject to clause 8.4.1, the total liability of all Trainers and Storm to you for any claim arising out of or in connection with the Services (whether in contract, tort, negligence or otherwise) will be limited to the total fees you have paid for Sessions in the 12 months immediately before the event giving rise to the claim.
8.5 Personal belongings
8.5.1 You bring your personal belongings to Storm’s premises at your own risk.
8.5.2 Trainers and Storm are not responsible for any loss, theft or damage to personal property unless caused by their negligence.
8.6 Trainer details on confirmations and receipts
8.6.1 The name of the Trainer who is supplying the Services for each Session will be shown on your booking confirmation, schedule and/or receipt wherever reasonably possible.
8.6.2 Where a payment covers Sessions delivered by more than one Trainer, your schedule or receipts will indicate, or records held by Storm will show, which Trainer is responsible for which Sessions.
9. GENERAL
9.1 Changes to these terms
These terms may be amended from time to time. The current version will be made available to you. Continued booking or attendance at Sessions will be treated as acceptance of any updated terms.
9.2 Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
9.3 Entire agreement
These terms set out the entire agreement between you and the relevant Trainer(s) in relation to the Services and supersede any prior discussions or understandings, whether written or oral.
